The government is publishing its revised plans for new powers for the police and the intelligence services to gather details of individuals' phone calls, emails and internet habits, saying that it has responded to the alarm its original plans stirred up.

Conservative MP David Davis told the Today programme that the proposal is still "incredible intrusive".

"The only people who will avoid being covered by this are the criminals" he told James Naughtie, as they "know their way around it".

"It will only catch the innocent and the incompetent," he said.

Home Secretary Theresa May defended the proposals, explaining that the bill is "ensuring the police and intelligence service can continue catching criminals and terrorists in a world where people are communicating using different means".

The data collected are "crucial bits of information", she told Jim Naughtie, and the bill was simply an "update" to existing powers.
