The firm recently sacked from the Bath Spa project has been charged over the death of one of its site workers.
In 2004, an inquest jury at Bristol Coroner's court returned a verdict of death by accident or misadventure on Arthur Cox, 54, from Bristol.
He died two weeks after being found semi-conscious on the ground in May 2003 after checking work on a roof.
The Health and Safety Executive (HSE) is bringing charges against Mowlem, which employed Mr Cox at the time.
Judicial review
The HSE has accused Mowlem of failing to ensure the health, safety and welfare of Mr Cox at work, or a safe system of work for what he was doing.
No date has been set for the prosecution because a judicial review is taking place into the wording of the inquest verdict.
One of the findings was that Mr Cox had died "when he fell from a ladder at work".
Mowlem went to the High Court and successfully argued these words should be changed because there was no proof that was how the accident had happened.
In a statement, the company said: "Mowlem plc confirms that it has been summonsed on two charges under the Health & Safety at Work Act.
"We are evaluating our response to those charges in the light of the recent decision of the High Court in London correcting the Coroner's Court Inquisition and striking out the Coroner's unlawful comments."
